Constitutional Clarity! Supreme Court Rejects PIL Seeking President’s Inauguration of New Parliament

Supreme Court: A request that President Murmu inaugurate the new Parliament was denied by the Supreme Court. The court rejected the PIL and stated that the Prime Minister is the executive head of Parliament while the President is the constitutional head since the case is not pertinent to this court (SC). An earlier PIL asking the Lok Sabha secretariat to arrange for President Droupadi Murmu to formally dedicate the new Parliament building was submitted to the Supreme Court.

Petition Asserts President’s Power in Indian Parliament

The top legislative body in India is the parliament. The Lok Sabha and Rajya Sabha are the two Houses that make up Parliament, according to the petition. Additionally, it stated that the President had the authority to call a prorogation of either House. The plea argued, “The President has the authority to dissolve the Lok Sabha or the Parliament.” According to the petition, it was “inappropriate” for the central government to not have invited the President to the inauguration event.

Opposition Calls for President’s Role in Parliament Opening

This event happened after 20 opposition parties, including the Congress, TMC, AAP, AIMIM, and JD(U), declared they would not attend Prime Minister Narendra Modi’s May 28 inauguration of the new Parliament building. Following Speaker of the Lok Sabha Om Birla’s request, PM Modi will officially open the new Parliament building on May 28. In the four-story structure will be more than 1,200 MPs. The opposition parties argued that President Droupadi Murmu, the head of state, rather than PM Modi, the leader of the government, should conduct the inauguration, which caused the situation to escalate into a significant dispute.
