Delhi High Court refuses to stay streaming of Gunjan Saxena’s biopic

The Delhi High Court on Wednesday refused a petition by Ministry of Defence (MoD) and Indian Air Force(IAF) that sought to stay the streaming of Netflix movie Gunjan Saxena: The Kargil Girl which is bases on the life of former Flight Lieutenant Gunjan Saxena.

Justice Rajiv Sakdher told additional solicitor-general (ASG) Sanjay Jain that the MoD should have taken the step earlier as the movie has already released and an interim injunction on the movie cannot be granted.

He also made Ms Saxena a party in the plea filed by MoD and IAF and demanded her direct response on the issue. The high court has also sought the response of Karan Johar led Dharma production which produced the film and Over The Top(OTT) streaming platform, Netflix, where the film has released. The next hearing has been now scheduled on September 18.

The plea filed by MoD and IAF, through the Central government stated that the makers of the film had presented IAF in bad light deliberately. The mentioned that the IAF “has always provided equal opportunities to the meritorious officers irrespective of their gender, caste, religion and region, etc.”

The plea also said that the makers of the film had represented the movie was based on the life of an IAF officer, Gunjan Saxen, therefore, the force agreed to provide all the possible assistance for an authentic and realistic portrayal of the facts.

The plea alleged that the makers didn’t reveal that film will showcase the misogyny angle in the force, leading to the negative portrayal of the air force.

The plea argued that the pact was a prerequisite under the 2013 guidelines and the “in-principle” approval accorded to the makers of the film was at all times subject to the execution of the said MoU.

“Such a movie cannot be fictionalised or dramatised to such an extent as in the present movie, wherein an entirely different perspective is created based on false and misleading facts/ events that leaves an adverse impression in the minds of the viewers, thereby tarnishing the image of the true characters and the organisation,” the Ministry argued.

The plea also stated that the final output of the film was not shown to a preview committee before the release and the makers went ahead without taking a no objection certificate from the force in question.

Gunjan Saxena: The Kargil Girl was released on August 11 and stars Janhvi Kapoor in the titular role. The film also features Pankaj Tripathi and Angad Bedi in pivotal roles.

India, China engages in 3rd military dialogue after fresh skirmishes at Pangong Tso

The Indian and Chinese militaries began the third round of talks at Chushul on Tuesday to resolve the fresh skirmishes at Pangong Lake in eastern Ladakh.

“A Brigade Commander-level talk started at 10 am in Chushul on the Indian side,” said a source.

National Security Advisor Ajit Doval is keeping a close and continuous monitoring of India-China brigade commander level talks in Chushul.

The Chinese Army attempted to transgress into Indian territory near the southern Pangong Tso bank in Ladakh. The incident took place on the intervening night of August 29 and August 30.

The Army said there were no violent clashes in the intervening night of Saturday and Sunday, as were witnessed during the extended bloody skirmish in the Galwan Valley on June 15.

These talks aim to resolve all contentious issues between China’s Peoples Liberation Army (PLA) and the Indian Army.

Chinese Foreign Minister Wang Yi said that the India-China boundary is yet to be demarcated due to which there would always be problems and the two countries should implement the consensuses between their leadership not to let differences from escalating into conflicts.

He said China is ready to manage all issues with India through dialogue.

Indian troops have also occupied hill tops and the Chinese want them to step back.
Talks between the two sides took place for five long hours on Monday also.

Indian and Chinese troops were engaged in skirmishes at the southern bank of the Pangong lake where the Chinese brought in close to 450 troops and attempted to change the status quo, the Indian Army said as it thwarted the opponent’s effort.

India and China are engaged in a standoff since April-May over the transgressions by the Chinese Army in multiple areas including Finger area, Galwan valley, Hot springs and Kongrung Nala.

The talks between the two sides have been going on for the last three months including five Lieutenant General-level talks but have failed to yield any results, so far.

Rhea, who was interviewed by a number of media channels in the past week, earlier sought protection for herself and her family. She had taken to Instagram to share a video where her father was being mobbed by the press gathered outside her complex.

“This is inside my building compound , The man in this video is my father Indrajit Chakraborty (retd. army officer). In covid times , these basic law and order restrictions need to be provided . Thankyou,” she had written while sharing the video.

In another video, she showed her building security guard, describing how he was attacked by the media. “Ram is my buildings watchman for the last 10 years , He is hurt , he was hit by #media. Media people have entered my building compound and hurt the security guards and my father . Is this not a crime ? Who is responsible for this ? Is there any law at all ? Are we barbarians? #justiceforram. Will the concerned authorities kindly take notice , there are children and elders living in this building too . Meanwhile, on Monday, Rhea was questioned by the CBI for the fourth consecutive day in connection with the death of actor Sushant Singh Rajput who was found dead at his Bandra residence on June 14. The prima facie of the case was assumed to be death by suicide, but tables turned after Sushant’s father filed an FIR against Rhea Chakraborty and her family for the abetment of suicide and money laundering.

The CBI is currently questioning all the people related to the deceased actor. According to media reports, the CBI has also sent a summon to Sushant’s sister Meetu who had visited him the week he died.

JEE Main 2020: NTA has taken extra measures to ensure the safety of candidates

The Joint Entrance Examination-Main or JEE for admission to IITS begins today across the country amid a surge in coronavirus cases and opposition by several non-BJP ruled states.

The Nagpur bench of Bombay High Court  said any student residing in flood-hit parts of Maharashtra’s Vidarbha region who cannot reach the exam centre or reaches late can apply to the National Testing Agency to seek a re-examination.

Candidates appearing for JEE (Main) examination in West Bengal had a difficult time reaching their test centres on Tuesday morning owing to heavy rain and lack of transport.

The government had asked all state transport utilities to commence bus services from 5 am in view of the exam, but several candidates in North 24 Parganas, Berhampur, Malda and Siliguri claimed that they had to wait for hours, braving downpour, to get a bus to reach their test centres.

Students leaving the examination hall say all safety protocols were maintained and that the test was conducted smoothly.

Due to COVID19, strict measures and safety protocols have been set up to ensure safe conduct of the examinations.

Staggered entry and exit for candidates, sanitisers at the gate, distribution of masks and maintaining social distancing as candidates queued up, were among the scenes witnessed at the exam centres across the country.

“Hand sanitisers are being made available at the entrance of the examination centre and inside the exam hall at all times. The usual process of checking the admit cards of candidates has been replaced with barcode readers, which have been made available to the examination centre authorities,” said an official of the National Testing Agency (NTA).

However, a parent complains about how the allocation of centre has been done “without any concern”. “B.Arch paper in one end of the city whereas B.Tech paper in another corner, my child has to travel over 2 hours to reach these centres,” the parent says.

Allahabad High Court cleared Dr Kafeel Khan of NSA charges, orders immediate release

The Allahabad High Court on Tuesday, 1 September, revoked the National Security Act (NSA) charges against Dr Kafeel Khan, and directed his immediate release.

The bench, comprising Chief Justice Govind Mathur and Justice Saumitra Dayal Singh, passed the order on a petition filed by Khan’s mother Nuzhat Parveen, who sought for his release on grounds that he had been detained illegally.

Dr Khan has been lodged in Mathura Jail for an allegedly provocative speech at the Aligarh Muslim University in the backdrop of protests against the Citizenship Amendment Act.

The Uttar Pradesh government had earlier extended his detention by three months till November 13.

In its last hearing, the HC bench adjourned the matter as parties prayed to file additional documents and the court wanted to pursue original records of the proceedings under the NSA, resulting in the detention of Khan and further extension of the same.

The first information report, filed on December 13, said that Khan had attempted to vitiate the peaceful ambiance at the university and disturb communal harmony.

The High Court also found prima facie that Khan’s speech “does not disclose any effort to promote hatred or violence”.
