”Why Not Apologise?”- Top Court said Prashant Bhushan

Lawyer Prashant Bhushan, has refused to apologise for his tweets on Chief Justice of India SA Bobde and the Supreme Court, should be pardoned with a warning, the government’s top lawyer said today.

“If you are hurting someone, then what is wrong in apologizing,” Justice Arun Mishra said. “For how long the system will suffer all this? I am retiring in a few days. Will it be okay if you or others start attacking me? You should apply balm if you have caused hurt.”

He said the tweets represented a bonafide belief that he holds and an apology, conditional or unconditional, would be insincere, in a 100-page statement. Retracting now would be a “contempt of my conscience” and the court, he said.

Mr Bhushan’s lawyer Rajeev Dhavan said, “this institution must take criticism, and not just criticism but extreme criticism. Your shoulders are broad enough.”

The lawyer said, “don’t make him a martyr

Justice Mishra was responding to arguments by Prashant Bhushan’s lawyer Rajeev Dhavan and Attorney General KK Venugopal.

Meanwhile, Dhavan also argued that an apology cannot be coerced.

According to Dhavan, Mr Bhushan can be forgiven with a message, not even a reprimand or warning. “Such reprimand or bald warning is too broad and shouldn’t be done. One cannot be silenced forever. A message that he should be little restrained in future should be enough.”

The lawyer said, “don’t make him a martyr, this controversy will continue depending on what punishment this court gives to him. And this controversy will end only if this court shows statesmanship.”

“You have to differentiate somewhere. Fair criticism is not a problem, it is for the benefit of the institution… If we are going to destroy each other, who will have faith in this institution? You have to be tolerant, see what the court is doing and why. Don’t just attack. Judges can’t go to press to defend themselves or explain,” Justice Mishra said.

Under the government’s listed goals, there are a lot of programs which emphasize on increasing the literacy, but as of now, there is no significant program or vision in increasing the mathematical abilities and numeracy which can put us ahead in the global race. Our visionary Prime Minister Narendra Modi should take the lead as I want to initiate and take ‘VISION MATH’ of India ahead. A robust plan like this will put India on the global map of excellence and bring back the old Indian Math Glory,” he added.

I also think it’s probably the product of this depressing pandemic time when people are getting the opportunity to vent their feelings in abnormal ways.

He also highlighted about the struggles in Bollywood. He reportedly said there could have been a case that Sushant was pushed around but added that, in the film industry, the struggle is a constant factor, but when success comes, one shines.

AICTE allows MBA admission on the basis of graduation marks.

When the students across the country is urging to postpone JEE and NEET exam fearing the Coronavirus, scheduled to be held in September, Institutions offering MBA and PGDM courses have been allowed to admit students based on marks obtained in qualifying undergraduate exams.

Several schools, colleges and other educational institutes have cancelled state and central level board exams, entrance and recruitment exams, as well as university-level exams, based on guidelines received from regulatory bodies like the CBSE, ICSE, or UGC.

A report by Careers 360 quoted member secretary of the AICTE Prof. Rajeev Kumar saying that the decision has been taken so that if the seats are left vacant in management institutes since the candidates were unable to appear for the exam, then on the basis of qualifying undergraduate marks they will be given admission to fill those vacant seats.

Admissions to post graduate diploma in management (PGDM) or MBA are based on all India tests like CAT, XAT, CMAT, ATMA, MAT, GMAT along with the seventh option of the common entrance test of the respective state. AICTE stated that while many states the entrance tests could not be conducted due to the fear of the spread of the Corona Virus, with no indication from the state there is also uncertainty over whether these tests are postponed or likely to be held or cancelled.

“AICTE, being more a facilitator than a regulator, considered alternative proposition through which selection of the students could be made for admission to PGDM course which will benefit both the institutions as well as the students.

The technical education regulator has clarified, the relaxation is being made available only for the 2020-21 academic session. This cannot be taken as a precedent for the future academic year.
