Delhi Govt Accuses Centre of Disobeying Supreme Court Ruling on Bureaucrats

Supreme Court: The years-long standoff returned to court when the transfer of an official was halted, a day after the Supreme Court decided that the Delhi government, not the centre, would be in charge of handling appointments of bureaucrats in the capital’s administration. The Supreme Court has been contacted by Arvind Kejriwal’s Aam Aadmi Party (AAP) government, who claims that the BJP-led federal government is preventing them from transferring a bureaucrat as soon as possible after the Supreme Court’s landmark decision. The centre could be charged with contempt of court, according to the local authorities.

Senior attorney Abhishek Manu Singhvi brought up the situation before Chief Justice DY Chandrachud and Justice P S Narasimha on behalf of the Delhi government, claiming that the top court had recently delivered its ruling and that the centre now looked to be disobeying it. The case will be listed, according to Chief Justice Chandrachud, next week. However, sources in the central government refuted the allegation and asserted that the centre’s announcement would need to be removed in order to execute the Supreme Court’s instructions.

However, a representative of the Delhi administration argued that the procedure needed to be drawn out. The Home Ministry notification instantly becomes infructuous because of the unambiguous court orders. The centre is purposefully delaying the implementation of the court’s decision, the officer claimed. Aam Aadmi Party (AAP) leader Arvind Kejriwal’s administration scored a major victory when the Supreme Court’s Constitution Bench unanimously ruled that the Delhi legislature has the authority to pass laws on behalf of the people. According to the bench, in a democratic form of government, the elected branch of government must hold the real power of administration. The bench also stated that the central government’s authority in areas where both the Centre and states can pass legislation is “limited to ensure that the governance is not taken over by the Central government.” In a press conference, Chief Minister Arvind Kejriwal announced a significant administrative shake-up in the government and threatened to take action against officials who “obstructed” public work.
