Uttar Pradesh: Azam Khan, a politician of the Samajwadi Party, was found guilty in a hate speech case brought against him over remarks he made in 2019 about Yogi Adityanath, the chief minister of Uttar Pradesh. Around 4 pm, the Rampur court in Uttar Pradesh, which found the top Samajwadi Party politician guilty, is anticipated to announce the severity of the punishment.
What was the case?
On April 9, 2019, a case was filed against Azam Khan at Milak Kotwali in Rampur under sections 153a (promoting enmity between two groups), 505-1 (statement conducing to public mischief), and 125 of the Representation of People Act 1951 for allegedly making provocative remarks against Yogi Adityanath, the then-CM of Uttar Pradesh, and IAS Aunjaneya Kumar Singh, the then-DM.
Azam Khan will likely lose his position as a result, as every MLA, MLC, or MP loses their membership in the house if they are found guilty of a crime and sentenced to a minimum of two years in prison.
Supreme Court decision from July 10, 2013
According to a Supreme Court decision from July 10, 2013, any MLA, MLC, or MP who is convicted in a criminal case and sentenced to at least two years in jail will immediately lose their membership in the house. The fear of losing power hangs over Khan because the maximum sentence under IPC sections 505-1 and 153a is three years.
