Elon Musk-owned social media platform X has filed a lawsuit against the central government, alleging misuse of the Information Technology (IT) Act to restrict content on its platform. The case was filed in the Karnataka High Court on Thursday.

Lawsuit Challenges Content Blocking Under IT Act

In its plea, X has challenged what it describes as "unlawful content regulation and arbitrary censorship" by the Centre. The micro-blogging platform has specifically raised concerns over the government’s interpretation of Section 79(3)(b) of the IT Act. According to X, this provision is being used in a manner that contradicts Supreme Court rulings and threatens free speech online.

The lawsuit claims that the government is employing Section 79(3)(b) to establish a separate content-blocking mechanism, effectively bypassing the structured legal process outlined in Section 69A of the IT Act. Section 69A provides a defined legal framework for content removal, including a review mechanism, but X argues that the government is circumventing these procedures.

X Sues Central Government Over Alleged IT Act Misuse

As reported by news agency PTI, X believes that this practice not only undermines the platform's independence but also restricts users’ right to free expression. The lawsuit seeks judicial intervention to prevent what it sees as an overreach by authorities in controlling online content.

The case is expected to reignite debates over digital freedom and government regulation of online platforms in India. This is not the first time X has been at odds with the Indian government over content moderation. Previously, the platform has faced pressure to comply with takedown requests related to political and social issues.

With the legal battle now in court, the outcome could have significant implications for how online content is regulated in the country and the extent of governmental control over digital platforms.
