Nirav Modi: Fugitive seeks permission to approach UK top court to appeal against his extradition  

Nirav Modi: Nirav Modi, a fugitive diamond trader, has urged the UK High Court for permission to appeal against his extradition to India in front of the UK Supreme Court. The 51-year-old diamantaire lost an appeal earlier this month on mental health grounds because the court determined that extraditing him to India to face fraud and money laundering accusations would not be oppressive or unreasonable.
His extradition to India was made possible by the UK high court on November 9, which was viewed as a significant victory for the CBI and the ED case against the businessman.

Indian Government’s plan of action following Nirav Modi’s appeal

The UK high court will receive a statement from Indian authorities via the Crown Prosecution Service (CPS) about Nirav Modi’s motion, after which a judge will issue a written decision. The judges had remarked, “We are far from satisfied that Nirav Modi’s mental condition and the risk of suicide are such that it would be either unjust or oppressive to extradite him.”

Additionally, they found sufficient evidence to believe that the Indian government will take its assurances on Nirav’s medical care in Mumbai’s Arthur Road Jail with “due seriousness.”
Nirav Modi had left India when the Punjab National Bank (PNB) scandal was discovered; he is currently detained in Wandsworth prison in London. The main suspect in the Rs 13,000 crore PNB case is Nirav Modi.

Why Indian government is attempting to repatriate Nirav Modi from the UK?

In response to being accused of robbing PNB of Rs 7,000 crore, money laundering, and witness intimidation, the Indian government is attempting to repatriate Nirav Modi from the UK.

Nirav Modi can apply to the European Court of Human Rights (ECHR) to try and block his extradition on the grounds that he won’t receive a fair trial if his bid to have his appeal considered in the top court is unsuccessful, according to news agency PTI. In April 2021, Judge Sam Goozee of the Westminster Magistrates’ Court issued a decision that led to the then-UK Home Secretary, Priti Patel, ordering Nirav’s extradition. Since that time, the case has been subject to an appeals procedure.

In relation to the PNB scandal, Nirav Modi is the target of two distinct sets of criminal proceedings. While the Enforcement Directorate (ED) is looking into the laundering of the proceeds of that crime, the CBI is looking into a significant fraud against PNB that involved acquiring letters of undertaking (LoUs) or loan agreements fraudulently.
