Bilkis Bano Challenges In Supreme Court On Release Of Her Rapists

Bilkis Bano has filed a review petition in the Supreme Court challenging the premature release of 11 convicts who were convicted of gangrape and murder of family members during the 2002 Godhra riots. In this, a demand has been made to reconsider the order of May 13. In this, the Supreme Court had said that the rules made in 1992 would be applicable for the release of gangrape convicts. On this basis, 11 convicts were released. The counsel for Bilkis Bano mentioned the matter before Chief Justice of India DY Chandrachud for listing. During this, the Chief Justice said that he will examine the issue whether both the petitions can be heard together and whether they can be heard before the same bench?

Even before this two petitions were filed two petitions have already been filed in the Bilkis Bano case. After the main petition, a petition was also filed on behalf of a women’s organization on October 21. A bench of Justice Ajay Rastogi and Justice CT Ravikumar clubbed this petition with the main petition. Both the petitions will be heard together. The top court is already hearing a petition filed by the ‘National Federation of Indian Women’. It challenges the remission of sentence and the acquittal of the convicts in the case.


The Supreme Court had said on October 18 that the response of the Gujarat government to the petitions challenging the remission of sentence was very overwhelming. It is missing factual statements. The apex court then fixed the matter for further hearing on November 29, giving time to the petitioners to file their reply to the affidavit filed by the Gujarat government.

Know what is the matter?

This case is related to the 2002 Gujarat riots after the Godhra incident. Then Bilkis Bano was 21 years old and five months pregnant. While fleeing the riots, Bilkis was gang-raped and seven members of her family were killed. His three-year-old daughter was also among the dead.

Released after serving 15 years in prison

On the other hand, the Gujarat government says that it has granted immunity to 11 convicts as per its amnesty policy. These convicts were released from jail on August 15 this year. The convicts have been released after serving more than 15 years in Godhra sub-jail.
