Delhi HC dismisses all the pleas pertaining to Agnipath scheme, report

In a landmark judgment, the Delhi High Court has dismissed pleas which challenged Agnipath Short Term Military scheme and upheld its validity. Agnipath scheme when it was launched triggered mass protests and fewer benefits it offered.

Delhi High Court upholds validity of Agnipath scheme

Bench comprising of Chief Justice Satish Chandra Sharma and Justice Subramonium Prasad, dismissed please which sought resumption and enrolment under previous recruitment scheme in defense services.

“This court does not find any reason to interfere with the scheme. All petitions challenging the Agnipath scheme are dismissed,”.

However, the bench had reserved its order on December 15 and asked parties to file their written submissions by December 23 before courts winter vacation. Further in July, the Supreme Court had transferred all the petitions and asked High Courts of Kerala, Punjab and Haryana , Patna and Uttarakhand to transfer the please against the scheme to Delhi High Court or keep them pending till a decision is delivered if petitioners so desire.

However, in August the Delhi High Court had declined to halt the scheme and said it would hear the matter instead of passing an interim order.

Agnipath Scheme formulated after extensive discussion among stakeholders

In the meantime in October that recruitment in the Armed Forces is an essential sovereign function keeping in mind national security in mind.

The Government had also stated that structural changes were necessitated in the context of the need for an evolution of a youthful, modern and futuristic fighting force and infuse young blood in the army which is physically and mentally fit. Further, the Union Government had stated that Agnipath is a ‘tailor made scheme’ which had been formulated after comprehensive discussion by experts to serve the needs of the nation and changing warfare.
