Sharjeel Imam granted bail in a sedition case

In a sedition case in which he was charged with inciting the Jamia riots in 2019, a Delhi court on Friday granted bail to former JNU student Sharjeel Imam, taking into consideration the Supreme Court’s ruling essentially suspending the sedition legislation from the colonial era.

The court also cited its observations from October 22, 2021, stating that there was no evidence on file to suggest the rioters took action after hearing Mr. Imam’s speech. This was done to grant bail to the student activist after almost two years and a half in prison.

“In view thereof and without commenting upon the merit of the present case, applicant or accused Sharjeel Imam is admitted to bail on furnishing personal bond in the sum of ₹30,000 with one surety of like amount,” Additional Sessions Judge Anuj Agrawal said.

The judge stated that the bail was contingent upon Imam maintaining constant accessibility via a functional mobile number and notifying the relevant Investigating Officer (IO) of any address changes.

The Supreme Court urged the Centre and the State governments to refrain from filing any FIRs under Section 124(A) (sedition) in a temporary order issued in May of this year while the Union government reviewed the clause.

For other comments he made during the anti-CAA rallies, including encouraging Islamists to cut off the North Eastern region from the rest of the country by blocking the “chicken’s neck” in North Bengal, Sharjeel Imam is currently facing other legal proceedings.
