The US has launched a major investigation into alleged H-1B and PERM visa fraud, with Cognizant mentioned during the ongoing probe.

The United States has launched a major investigation into alleged fraud involving the H-1B and PERM visa programs, signaling a tougher approach to immigration enforcement. US Begins Large-Scale H-1B Visa Fraud Investigation

The investigation is being led by the Office of the Inspector General (OIG) under the US Department of Labor. Officials say the probe focuses on alleged misuse of H-1B and PERM visa programmes, including fraudulent applications, labour trafficking, coercive wage kickback schemes, and practices that may disadvantage American workers. The authorities have reportedly begun issuing multiple subpoenas as part of what they describe as one of the most aggressive enforcement efforts targeting foreign worker visa abuse.

Cognizant Comes Under Investigative Scrutiny

As reported by The Times of India, the Inspector General for the US Department of Labor, Anthony D’Esposito, has revealed that whistleblower claims revealed that companies such as “Cognizant” were involved in information under scrutiny from the investigators. He pointed out that every credible tip received during the course of the investigation is being investigated. Nevertheless, there is no mention of the fact that Cognizant has been accused of any misconduct.

 H-1B Visa Program

The H-1B visa program allows American companies to recruit foreign nationals in specialized professions where they need specific skills and knowledge. This program is widely used in various fields such as IT, engineering, medicine, finance, and researchOn the other hand, the PERM labor certification program allows eligible employers to file for employment-based immigrant visas by proving that qualified US workers are not available for the job position.

Potential Impact on Employers and Skilled Workers

The investigation may lead to stricter oversight of companies participating in employment-based visa programs. Industry experts believe employers could face enhanced compliance requirements, increased documentation standards, and more frequent audits.
