Rhea Chakraborty’s lawyer hails SC ruling, says ‘case has lost total steam’

Reacting to Supreme Court’s judgement on confessional statement made before CBI, Rhea Chalraborty’s lawyer, Satish Manshinde said that a now a large number of accused will see the light of the day.

The court in its judgement ruled out that confessional statement made before investigating officers by those who have been accused can not be used to convict them. The court said that it would be equal to infringement of individual rights fundamental rights to life, equaltiy and protection against self-incrimination.

Calling it a landmark judgement, Mr Manshinde said, “The Judgement rendered by the Hon’ble Supreme Court in respect of Section 67 of the NDPS Act is a Landmark pronouncement. A large number of people have been incarcerated and punished on the basis of statements forcibly extracted by using third degree, coercion and threats to innocent individuals violating their Fundamental Rights in the last 35 years.”

Rhea Chakraborty has been accused of procuring drugs and was arrested under NDPS act. As of now, she is out on bail.

Talking about the drug angle in Sushant Singh Rajput case, Mr Manshinde said, “Even in the case of all accused in the SSR Drugs Angle case, there’s hardly any recovery and independent evidence to charge them of serious offences. They are languishing in custody on the basis of inadmissible statements. In view of this Judgement rendered by Justice Rohington Nariman and Navin Sinha a large number of accused will see the light of the day.” Noting that the judgement will work in favour of “downtrodden people languishing in our overcrowded ill-maintained jails,” Maneshinde concluded: “Rhea Chakraborty’s case has lost total steam in the merits of the allegations by virtue of this Judgement.”

The NCB has arrested over 20 people in connection to the alleged drugs nexus that emerged during the investigation of Sushant Singh Rajput death case in the film industry. The agency had earlier quizzed actors such as Deepika Padukone, Sara Ali Khan, Shraddha Kapoor and Rakul Preet Singh.

Covid-19 update: India reports 48,648 cases, 563 new deaths

India reported fresh new 48,648 fresh cases in last 24-hour, taking total toll to 80,88,851. With new 563 new deaths, the total toll mounted to 1,21,090.

Total active cases are 5,94,386 after a decrease of 9301 in last 24 hours. Total cured cases are 73,73,375 with 57,386 new discharges in last 24 hours, health ministry said.

The active cases have reached below 6 lakh mark and are at 5,94,386 as of today, which comprises 7.35 percent of the total caseload. Maharashtra, Andhra Pradesh and Karnataka have reported the highest number of cases in last 24-hour.

Total 10,77,28,088 samples tested up to 29th October. Of these 11,64,648 samples were tested yesterday: Indian Council of Medical Research

The very high testing has resulted in the continuously falling positivity rate of 7.54% presently, says health ministry.

*Mexico’s health ministry reported on Thursday 5,948 additional covid-19 cases and 464 more deaths in the country. The total case now stand at 912,811 and the death toll to 90,773.

*Mainland China reported 25 new Covid-19 cases on October 29, the country’s national health authority said.

*Delhi’s COVID-19 tally increased to 3.75 lakh on October 29 with the national capital reporting a record 5,739 new cases in 24 hours. The death toll in the city now stand at 6,423.

*Dr. Anthony Fauci, the top US infectious diseases expert, on Thursday, said that first doses of a safe vaccine will likely become available to Americans in late December or early January.

*India has exponentially scaled up its TESTING capacity from one in January to more than 10.65 cr at present: Ministry of Health said.

*Apple has temporarily closed 17 out of 20 French stores amid fresh lockdown measures.

Meanwhile, the overall number of global coronavirus cases was nearing the 45 million mark, while the deaths have surged to 1,179,270, according to the Johns Hopkins University.

As of Friday morning, the total caseload and death toll stood at 44,908,477 and 1,179,278, respectively, it said.

3 BJP workers killed in terrorist attack in Jammu and Kashmir’s Kulgam district

Three BJP workers, including a local youth wing leader, were on Thursday killed in a terror attack in Kulgam district of Jammu and Kashmir, police said. They were travelling in a car when terrorists fired at them in YK Pora area.

Police said the terrorists opened fire at the three BJP workers in YK Pora of Qazigund, killing one person on the spot and critically injuring the other two.

The injured were rushed to a hospital in Qazigund where they were declared brought dead on arrival, police said. They have been identified as Umer Rashid Beigh and Umer Ramzan Hajam.

“Terrorists fired upon three BJP workers who are identified as Fida Hussain Yatoo, Umer Rashid Beigh and Umer Ramzan Hajam in YK Pora, Kulgam, today. They were shifted to a nearby hospital for treatment where they were declared as brought dead,” Jammu and Kashmir Police said.

The Resistance Front (TRF), which is believed to be a shadow group of the Lashkar-e-Taiba, has claimed responsibility for the killings.

In a message in English and Hindi on its social media account, the TRF said “crematoriums will get overbooked”.

“Investigation is in progress and officers continue to work to establish the full circumstances of this terror crime. Area has been cordoned off and search in the area is going on,” a statement issued by the local police said. 

The BJP’s Jammu and Kashmir unit tweeted condemnation of the terror attack.

“J&K BJP strongly condemned this barbaric terror attack on BJP Leaders Fida Hussain Itoo (BJYM District Gen Secy Kulgam), Umer Rashid Beigh (BJYM District Executive Member Kulgam), Umer Hanan (BJYM District Gen Secy Kulgam), those who are responsible for this will not be spared,” it said.


Mumbai police summon investors of Republic TV over TRP scam

The Mumbai Police has summoned five Republic TV investors to appear before them on Friday over the alleged TRP scam. The special investigation team of Mumbai police probing the alleged manipulation of Television viewership by certain channels including Republic TV have sent out 91 notices to Republic TV so far.

The police have previously quizzed Republic TV officials inlcuding chief financial officer Shiva Sundaram. They also arrested the owner of Max Media, Abhishek Kolwade, who allegedly admitted receiving payments from two channels including Republic TV for manipulating TRP.

Mumbai police had issued summons to the owners of RPG Power Trading Ltd, Anant Udyog LLP, Purvanchal Leasing Ltd, Pan Capital Investment, Dynamic Storage and Retrieval Systems Private Ltd to join the investigation on October 23.

Police have also suspected Hansa group’s involvement in the TRP scam over a payment of Rs 32 lakh by the company to media channel.

SIT is also conducting prove against five other firms including Box Cinema, Fakt Marathi, Maha Movie, News Nation and Wow for allegedly paying households to watch their channel.

Meanwhile, Republic TV has said that the Mumbai Police is launching a “witch-hunt” against them, displaying their “intimidatory tactics”. The channel said that the SIT has asked every investor of the channel to present all financial transactions relating to last five years.

Explaining payment received from Hansa Group, Republic TV has said that the payment was made for advertising purposes. The channel denied any previous connect to the Hansa Research, the company which was contracted by Broadcasting Audience Research Council to install bar-o-meter to manage viewership patterns.

PM Modi on two-day Gujarat trip from October 30, to inaugurate various projects

Prime Minister Narendra Modi will visit Ahmedabad and Kevaidya as a part of his two-day Gujarat trip to launch a host of projects. The Prime Minister will arrive in Ahmedabad on Friday morning wherein he is scheduled to launch the famed seaplane service between Kevadiya and Ahmedabad.

PM Modi will also be visiting the grieving family of former Gujarat CM Keshubhai Patel who passed away on Thursday. The 92-year-old leader was suffering from a prolonged illness.

PM Mod expressed deep pain on the passing away of the stalwart trhough a series of tweet.

“Our beloved and respected Keshubhai has passed away I am deeply pained and saddened. He was an outstanding leader who cared for every section of society. His life was devoted towards the progress of Gujarat and the empowerment of every Gujarati,” he said .

After visiting the family of late leader, PM Modi will leave for Kevadiya in Narmada district. He would be taking helicopter ride from the Ahmedabad airport to Kevadiya. Later, he is expected to visit Statue of Unity and inaugurate the Sardar Patel Zoological park dedicated to the ‘Iron Man of India’.

The zoo houses will have wild animals and birds brought from all over the world.

PM Modi would then inaugurate Ekta Mall near the statue where tourists can buy handicraft items brought from all over the country, an official said.

On October 31, to mark Sardar Patel’s birth anniversary, the PM will visit the Statue of Unity to pay floral tribute. On the occasion, a parade, named Ekta Diwas Parade, by Central Armed Police Forces (CAPF) and the Gujarat police will also be organised, the official said.

Later in the afternoon, PM Modi will launched the seaplane service and thereafter, he will return to New Delhi.

“Schools would be run on alternate days in three phases for which officials are making arrangements. Precautionary measures would be taken to contain the spread of COVID-19,” Sawhey said.

However there are still speculations about the college reopening but schools will get opened from November 2 for classes 9 to 12, while tll Novemeber 23 all the schools will be opened in the state.

SC backed Uttarakhand HC decision of CBI probe into graft allegation against BJP Chief Minister

The Supreme Court supported Uttarakhand High Court and asked to stay on its order for a CBI probe in a corruption allegation against Chief Minister Trivendra Singh Rawat.

Two journalist came forward and alleged that CM Rawat is transferring money to accounts of his relatives back in 2016 for appointment of a person in Jharkhand to head Gau Seva Ayog.

Justice Ravindra Maithani also ordered quashing of the FIR against the journalist, Umesh Kumar Sharma.

The state government will move the Supreme Court with a Special Leave Petition challenging the order, Darshan Singh Rawat, media coordinator of the CM, said. “The government respects the High Court order. Facts will be cleared in the inquiry,” he said.

Hearing the petition, Justice Maithani stated, “…this court can, within the scope of jurisdiction under Article 226, order for investigation into allegations levelled by the petitioner in para 8 of the petition. This court is of the view that considering the nature of allegations levelled against Trivendra Singh Rawat, Chief Minister of the State, it would be appropriate to unfold the truth.”

It held, “It would be in the interest of the State that the doubts are cleared. Therefore, while allowing the petition, this court proposes for investigation also.”

The court also stated, “The allegations as levelled in the instant FIR do not make out any prima facie case against the petitioners.”

Bihar assembly elections 2020 – second phase of election on 3 November

For the RJD, the second phase of Bihar assembly election is very important. Out of the 94 seats in this phase, RJD won about one-third in the last election. In the same phase, the electoral fortunes of many veterans, including Tejashwi Prasad Yadav, former minister Tej Pratap Yadav, the face of the Chief Minister’s post from the Mahagathbandhan, are to be decided. The second phase is to be voted on 3 November. RJD is contesting 56 seats in this phase. It has 31 seating seats. The RJD was the largest party, winning 80 seats in the last election. In the second phase of the election in the state, 495 (34 per cent) out of 1463 candidates are crorepatis. At the same time, about 10 percent of 147 women candidates are there. Out of the total candidates, 502 (about 34 percent) candidates have declared criminal cases against themselves and 389 (about 27 percent) candidates have declared serious criminal cases against them. According to ADR data, most RJD candidates have criminal cases. 56 RJD candidates are in the fray.

Violence In Munger: Angry Mob Vandalise SP Office

Three days after a person was killed during a police baton charge and firing by unidentified persons in Bihar’s Munger, the Election Commission of India (ECI) on Thursday ordered the immediate removal of Munger’s District Magistrate Rajesh Meena and Superintendent of Police Lipi Singh.

Rajesh Meena is district magistrate and Lipi Singh is SP of Munger. The EC statement said Munger will get a new DM and a superintendent of police on Thursday itself

Also, an inquiry has been ordered into the incident by Magadh Divisional Commissioner Asangba Chuba Ao. The inquiry has to be completed in the next seven days.

Alleging that no action was taken against the SP and other police personnel over the Monday night incident, the agitators allegedly torched muffasil and women police stations in the town.

They allegedly set police outposts at Purab Sarai and Basudeopur on fire, and ransacked the SP office and several other police stations and outposts.

A mob also burnt vehicles in the police station. 

An officer posted in Vasudevpur OP said that around 150-200 people suddenly came and started pelting stones at the OP and then set it ablaze. “We somehow managed to save our lives,” he said.

The Bihar Police conducted a flag march in Munger on Thursday after a mob vandalised the office of Sub Divisional Officer (SDO) and Superintendent of Police (SP) while protesting against a man’s death during Durga idol immersion clashes on October 26.

A man was shot during the Durga idol immersion ceremony in Munger after clashes broke out due to the slow pace of the procession.

“Munger incident is under investigation. Clashes erupted due to the pace of idol immersion,” Jitendra Kumar, Additional Director General of Police, said.

The office of sub divisional officer (SDO) was also allegedly targeted by the protestors, official sources said.

Witnesses said that finding themselves outnumbered, the police personnel at all these stations escaped from the premises.

Tension is prevailing in the area after the incident and additional police has been deployed in the city.
